Pursuant to Law No. 6698 on the Protection of Personal Data (the "PDPL"), since Kadir Büyükkaya Shop Giyim San. ve Tic. A.Ş. ("Kadir BÜYÜKKAYA/the Company") has an obligation to inform (PDPL art. 10) in its capacity as data controller, the purpose of this text is to inform you, within this scope, about the processing of your personal data and about your rights as a data subject.

The purpose of this text is to inform you about personal data processing procedures in the event that;

• you visit Kadir BÜYÜKKAYA stores ("Stores") and/or make purchases from the Stores,
• you visit Kadir BÜYÜKKAYA's website with the extension kadirbuyukkayashop.com (the "Site") or become a member of the Site, make purchases through the Site or through websites/mobile applications that sell Kadir BÜYÜKKAYA products ("Online Channels"), or send products/gifts on behalf of third parties, 
• you consent to receiving general and personalised campaign notifications through commercial communication channels,
• we communicate with each other through our communication channels,
• you participate in campaigns, competitions, prize draws and other events organised by Kadir BÜYÜKKAYA. 

As Kadir BÜYÜKKAYA, we use cookies and similar methods on the Site for the purposes of carrying out statistical studies regarding Site usage, delivering targeted advertising/promotions and enabling you to have an effective customer experience. 1. What Are Our Purposes for Processing Your Personal Data and Which Personal Data Do We Process? 

If you visit our Stores;

• we process your store security camera recordings for the purpose of ensuring the safety of you, Kadir BÜYÜKKAYA and its employees and other third parties against any act, offence or conduct contrary to legislation that may occur in the store, and of fulfilling our obligations to provide information and documents to official/judicial institutions and organisations and our other related obligations,
• in the event that you wish to be notified when a product you want arrives at the store, we process your name and surname, telephone number and, if provided together with your request, your clothing size and shoe size data in order to meet this request.

If you make purchases from our Stores;

• we process your name and surname, province-district information, purchase information (purchase date, time, amount, purchase content) and payment information (payment method and payment details) for the purpose of carrying out purchase transactions and, in connection therewith, concluding and performing the sales contract, issuing invoices and following up accounting matters; additionally your e-mail address for the purpose of ensuring that the e-invoice/e-archive invoice relating to your purchase is sent to you electronically; additionally your Turkish ID Number and passport number if you reside abroad and wish to benefit from the VAT refund; and your name and surname and mobile telephone number for the purpose of providing after-sales support services (such as alteration, exchange, return, product examination), and in addition to these your signature information in the event that an expense voucher is issued, 
• in the event that the purchase is made by credit/debit card, your credit/debit card information, provided that it is transferred to the relevant payment institution without being recorded by Kadir BÜYÜKKAYA,
• in addition to these, your Turkish ID Number data that you share to be included on the invoice, either mandatorily in the event that your purchase amount exceeds the legally determined amount or upon request, for the purpose of fulfilling our legal obligations, together with your sole proprietorship information to be included on the invoice if you are a taxpayer,

If you visit our Site;

• In the event that you visit our Site, we use cookies and similar methods on the Site and process your Site usage (browsing) information for the purposes of carrying out statistical studies regarding your usage, delivering targeted advertising/promotions and enabling you to have an effective customer experience. If you become a Site Member;

• we process your name and surname, e-mail address and mobile telephone number for the purposes of creating your membership and recording your membership information, enabling member log-in, providing notifications regarding your membership, performing the requirements of the membership agreement, and enabling log-in to the Site using member information without the need to re-enter all membership information as well as enabling purchases to be made without the need to enter membership information, and your log records for the purpose of ensuring transaction security, 
• additionally your address information, in the event that you save it to be used when you wish to make a purchase through the Site as a member, 
• User ID information, since it is assigned automatically during membership,
• your purchase information (purchase date, time, amount, purchase content) and payment information (payment method and payment details) for the purpose of being able to provide you, as a member, with the service of viewing your order history,
• your name and surname, gender, and if you choose to share them optionally, your date of birth, e-mail address, mobile telephone number and the User ID information automatically assigned by the system when you become a member of the Site, for the purpose of updating the information you provide during membership procedures or through other channels to Kadir BÜYÜKKAYA and/or ensuring that information you subsequently change is also updated for the information you have provided in respect of all your memberships, and of fulfilling our obligation to keep your personal data up to date, 
• we process your name and surname, gender, e-mail address, mobile telephone number, and if you share them optionally, your date of birth, province, district, demographic information, approaches towards in-Site notifications/surveys/offers/campaigns, habits, favourites, likes, behaviours, preferences, search movements, segments, past purchases, cookie records, cookie and advertising identifier/ID information and device ID, communication preferences, purchase amount, payment methods/channels and preferences, information on the bank through which payment was made, brand, model, technical specifications and operating system information of the device used, information on the operator used, and survey answers, within the scope of offering you special opportunities and offers based on your Site membership and purchases, creating general or personalised campaigns, advantages, promotions and advertisements, organising campaigns, competitions, prize draws and other events, carrying out segmentation, profiling, reporting, marketing and analysis studies, carrying out Kadir BÜYÜKKAYA's advertising and marketing/communication activities on the Site or in other third-party environments (notifications on the Site, pop-up displays, personalised offers, customisation of user screens, surveys, etc.), studies aimed at improving the customer experience, and strategic planning, analysis and business development studies relating to operational processes.

If you make purchases through online channels (as a member or otherwise);

• in the event that you make a purchase through the Site as a member or without being a member, we process your name and surname, signature, e-mail address, mobile telephone number, address, clothing size and shoe size, log records relating to your purchase transaction and your IP address, for the purposes of carrying out the purchase transaction and performing the requirements of the distance sales contract, ensuring that the e-invoice/e-archive invoice relating to your purchase is issued and sent to you, delivering your order to you, and being able to provide after-sales support services (such as alteration, exchange, return, product examination), 
• in the event that the cash-on-delivery payment option is used, your name and surname on the credit/debit card, credit/debit card number, the bank to which the card belongs and IBAN number data, should a refund need to be made,
• in the event that the purchase is made by credit/debit card, your credit/debit card information (first 4 and last 4 digits, expiry date, points, information on the bank to which the card belongs and the card type) for the purpose of enabling the payment to be collected,
• in the event that the purchase is made by money transfer/EFT, your name and surname, information on the bank through which the transaction was carried out, and, if shared, the information contained in the receipt,
• we process your order information (your order, its date, time and amount, product information forming the content of the order, order information such as the payment method, order/gift note, reference number relating to the order) and, in the event that you query your order using the order query screen, your e-mail address and order number data.
• In the event that you make a purchase through websites/mobile applications that sell Kadir BÜYÜKKAYA products, we process your name and surname, e-mail address, delivery and invoice address and order details (product information, price, order date, order content) for the purposes of performing the requirements of the distance sales contract, ensuring that the e-invoice/e-archive invoice relating to your purchase is issued and sent to you, and delivering your order to you.

If the purchased product is sent to a third party; 

• In the event that you send a product to third parties, we process the relevant person's address and the name and surname contained in the address, for the purposes of delivering the order to the relevant person and being able to provide after-sales support services (such as alteration, exchange, return, product examination). In this case, the responsibility for informing such person(s) belongs to you, as the person sharing this information.
• In the event that a product/gift is sent to you by third parties, we process your address and the name and surname contained in the address, for the purposes of delivering the order to you and being able to provide after-sales support services (such as alteration, exchange, return, product examination). 

If you give Kadir BÜYÜKKAYA commercial communication permission through any channel;

• In the event that you give Kadir BÜYÜKKAYA commercial communication permission/explicit consent through any channel, we process your name and surname, User ID, mobile telephone number, e-mail address and log record information, and your signature if you carry out your commercial communication permission transactions at the store, for the purposes of being able to carry out commercial communication activities through the channels you select (SMS, e-mail, etc.) within the scope of general or personalised campaigns, advantages, product and service promotions, survey studies, presentation of customer satisfaction applications, promotions, advertisements, notifications and marketing activities conducted by Kadir BÜYÜKKAYA, and of sending you our invitations relating to campaigns, competitions, prize draws, invitations and other events.

If you contact us through our Communication Channels;

• In the event that you contact us through the call centre, e-mail, the Site, social media and similar channels (our "Communication Channels"), we process your name and surname, social media username, e-mail address, mobile telephone number, and if shared, landline telephone number, clothing size, shoe size, and where relevant your legal transaction information, your requests and complaints, and where necessary in relation to or for the finalisation of your request or complaint, your log record data and other related information to be provided by you in connection with your request and complaint, for the purposes of resolving the requests and complaints you convey to us and being able to contact you where necessary, being able to address you correctly when you contact us through our call centre, ensuring service/transaction security, managing, following up and reporting all customer relations processes better, and within the scope of studies aimed at improving quality standards, 
• your call centre voice recordings, for use in our customer satisfaction studies and as evidence in disputes that may arise between us, 
• your store security camera recordings, in the event that your request and complaint relates to our Stores, 
• in addition to these, your order and purchase history, invoices and use of points/discounts/benefits, in the event that you create an order or make a purchase through the Site.

Legal Processes and Internal Activities

• We process your name and surname, gender, and if you share it optionally, your date of birth, your signature and Turkish ID Number where these are transferred due to legal processes or contained in documents sent by official authorities, mobile telephone number, e-mail address, address, requests and complaints, purchases, clothing size and shoe size, order note, invoices, payment information (first 6 and last 4 digits of the credit/debit card, payment amount, information on the bank to which the card belongs, reference number), call centre voice recordings, commercial communication permission information, log records, User ID and IP address in the event that you carry out transactions through the Site, Facebook ID information that is necessarily transferred to us in the event that you log in to the Site with your Facebook account, store security camera recordings in the event that you carry out transactions at the store, your relevant legal transaction information and your correspondence and file information relating to dispute processes; within the scope of ensuring the safety of you, Kadir BÜYÜKKAYA and its employees and other third parties against any potential act, offence or conduct contrary to legislation, fulfilling our obligations arising from legislation and our legal obligations towards competent and authorised private or public institutions and organisations, exercising all rights of action, response and objection before official institutions and organisations such as courts, enforcement offices and arbitration committees in disputes that may arise, conducting negotiation and settlement processes relating to disputes, ensuring that the necessary information can be conveyed to you in the event that you request information from us or make an application within the scope of your legal rights, preventing use contrary to the contract and legislation, being able to detect suspicious transactions and unlawful use, being able to carry out cancellation transactions, carrying out internal audit and control, reporting, testing and development studies, and carrying out studies and developments aimed at improving the customer experience and strategic planning, analysis and business development studies relating to operational processes,
• As regards Online Visitors, we process your cookie records (IP address, browsing information, information on the device used (ID) and traffic data) for the purposes of ensuring information processing security and preventing malicious use, conducting activities in compliance with legislation, and fulfilling our other legal obligations towards competent and authorised public institutions and organisations. 

2. What Is Our Method of Collecting Your Personal Data and Our Legal Basis?

We collect your personal data by automated methods — by the Stores, business partners or suppliers, including dealers with whom we use a common customer management and point-of-sale system; through the security cameras and devices located in the stores; by recording in our systems the information you state verbally to sales advisors in the stores; by recording in our systems the information you provide during your purchases made through the Store/Site/or websites selling Kadir BÜYÜKKAYA products, or during your membership registration on the Site, and by your carrying out transactions through these channels; by recording in our systems all kinds of purchases, collections, deliveries, transactions, survey completions, registrations, behavioural movements and transactions on the Store/Site; by recording the requests and complaints you convey to us during mutual communication through our Communication Channels, the Head Office or the Stores; and by recording the calls you make with the call centre — and by non-automated methods, such as recording information/documents concerning you received from official institutions, organisations and judicial/administrative authorities, and recording in the relevant documents the records relating to your return/examination processes.

We collect/process your personal data on the following legal bases; 

• "the necessity of processing personal data belonging to the parties to a contract, provided that it is directly related to the conclusion or performance of that contract", in relation to the establishment of Site membership and the fulfilment of our obligations under the membership agreement, and to the sales and after-sales support processes,
• the "explicit consent" you will give in relation to personal data processing procedures and commercial communication activities within the scope of marketing, segmentation and analysis studies relating to Site membership, 
• "the necessity of data processing for the legitimate interests of the data controller", in relation to the detection and prevention of suspicious transactions concerning Site membership and Site use, ensuring transaction security, studies relating to operational processes (strategic planning, analysis and business development studies) and our customer relations processes,
• "the necessity of data processing for the legitimate interests of the data controller", "the necessity of data processing and transfer for the establishment, exercise or protection of rights" and "the fulfilment of a legal obligation", in relation to the processes of recording by security cameras in the Stores, 
• "the fulfilment of a legal obligation" and "being expressly provided for by law", in relation to our obligations arising from legislation,
• "the necessity of data processing and transfer for the establishment, exercise or protection of rights", in relation to legal disputes, investigations and other judicial/official processes, 
• the data having been made public by the data subject himself/herself. 

At any time you wish and without giving any reason, you may (i) stop the relevant commercial communication by carrying out the procedure (refusal) indicated in the commercial electronic messages we send, and/or (ii) terminate your membership by withdrawing your explicit consent relating to Site membership, and thereby stop the personal data processing procedures based on explicit consent. 

3. To Whom and For What Purpose Do We Transfer Your Personal Data?

As Kadir BÜYÜKKAYA, we transfer your personal data to third parties only in line with the purposes stated in this Text and in compliance with Articles 8 and 9 of the PDPL. Within this scope;

• We transfer it to business partners, suppliers and service providers located in Türkiye and abroad (such as electronic message intermediary service providers, the call centre, tailors from whom product alteration services are obtained, those collecting personal data through devices, marketing/advertising/analysis service providers, database and server service providers, infrastructure maintenance and support service providers, providers of legal and financial consultancy services, e-invoice/e-archive invoice service providers, independent audit service providers, and providers of shipping/courier, archiving and warehousing services), for the purposes of delivering to you the products you will purchase in connection with your membership, orders or purchases, being able to provide logistics services and after-sales support services, resolving your requests and complaints and being able to contact you where necessary, and obtaining information technology, marketing/advertising/analysis services or consultancy and similar services requiring expertise — provided that it is used by these firms within the scope of the services provided for the purpose of carrying out Kadir BÜYÜKKAYA's activities.
• In the event that you purchase Kadir BÜYÜKKAYA products through websites/mobile applications on which Kadir BÜYÜKKAYA products are sold, we transfer the information relating to your order and the information about the latest status of the order to the operators running the relevant website/mobile application, for the purposes of fulfilling our contractual obligations towards those operators and enabling them to inform you about the status of the order. 
• We transfer the information requested from us to competent and authorised private or public institutions and organisations, judicial authorities and official institutions/organisations, for the purposes of fulfilling our obligations to provide information and documents to them and our other related obligations, and of being able to exercise our legal rights such as rights of action and response.
• We transfer it, where necessary, to our suppliers from whom we obtain consultancy services and to the payment institutions relating to the transaction concerned, for the purposes of following up and detecting suspicious transactions and preventing unlawful transactions.
• We transfer it to our suppliers within the scope of activities relating to increasing Site visit traffic.
• In the event that you make your payment by credit/debit card, we transfer your credit/debit card information — without it being recorded by Kadir BÜYÜKKAYA — to third parties providing such services, such as the relevant bank and electronic payment institution.
• We transfer it to dealers with whom we use a common customer management and point-of-sale system, for the purpose of carrying out business processes.

4. What Are Your Rights Under the PDPL?

You may at any time convey your requests under Article 11 of the PDPL relating to your personal data processed by Kadir BÜYÜKKAYA to the addresses below, in writing in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, or by using the e-mail address you have previously notified to Kadir BÜYÜKKAYA and which is registered in our system.
